Why outsource your HR – Staying on the right side of employment law

Employment law is complex and is always evolving, even more so over the last 2 years.  Keeping on top of these changes and keeping records up to date can be time consuming but getting it wrong can be very costly.  Employment tribunals are on the rise, something all companies want to avoid.

Are you recruiting?

When you need to recruit, first you should identify what the role will entail and produce a job description, which can help the candidates applying, the interview and selection process and ensure you are not discriminating.

Next there are things you need to think about that the candidate will want to know, how much to pay, setting up a pension scheme, who will process your payroll, what benefits will you offer, what policies do you need, what will their induction/training look like to name just a few.

Legal documentation

Once an offer has been made you need to issue a contract of employment to all employees no later than day one (legal requirement since 6 April 2020), have a disciplinary & grievance procedure and data protection privacy policy.  These should be fit for your business and protect both you as the employer and the employee.

We would strongly recommend that as your employee numbers increase, that you have an employee handbook which would include all of your company policies.

Keeping on track

The next step is to keep on track and ensure that you have a performance management process to deal with any issues/development needs as soon as possible, what HR software you need, how will you keep staff records, what future training and development they might need and how this will be provided.

Health, wellbeing and equality

Now more than ever it is also important to look after your employee’s health and wellbeing ensuring diversity, inclusion and equality are also taken into consideration.  You might want to consider introducing an employee assistance programme for example or online training.

Along the way you may come across problems that need to be addressed and managed.  Are your managers trained to deal with sickness, absence, disciplinary and grievances?  Ensure you have the resources and ensure records are kept, including ‘informal discussions’

Would you consider taking out tribunal insurance to protect your balance sheet?
