Employment Rights Act: Unfair dismissal changes
During the 2024 general election, one of Labour’s key manifesto commitments was to introduce day one unfair dismissal rights for employees through the Employment Rights Act.
Fast forward two years and, following a back and forth stand off with the House of Lords, a six-month qualifying period is due to be introduced from 1st January 2027.
In practice, this means businesses may no longer be able to rely on short service dismissals in the way they have before for ordinary unfair dismissal claims.
